Malaysia Issues Circular on Transition Period for Medical Device Advertisement

On 20 May 2020,  the Medical Device Authority (MDA) of Malaysia has issued a circular pertaining to the transition period for medical device advertisement.

The aim of the circular is to enact a  policy under the  Medical Device Act 2012 (Act 737) to enable establishments to abide by the requirements of advertising of medical devices in the country.

Initially, the Medical Device (Advertising) Regulation 2019  was to take effect from 1 July 2020 onward, however, there are issues pertaining to the implementation of the regulations that require extra time, and as such the implementation date has been further extended.

MDA has granted a transition period of 18 months (commencing from 01 July 2020 until 31 December 2021) to implement the regulation.  The extension will enable MDA and the industry to explore the details with regards to the implementation of the regulation.

This transition period is carried out administratively prior to the revision of the Medical Device (Advertising) Regulation 2019.
